TOPIC: Using up holiday entitlement as part of redundancy

Using up holiday entitlement as part of redundancy 6 Months ago
Am I right in thinking that my company have no right to force me to use the holiday I haven't taken, and are obliged to pay me what I'm owed at the end of employment?

I have recently opted to take redundancy as our office is shutting and the offer of relocation to london is 'unreasonable' for me. I am now working through my notice period and have been asked/almost forced to take my holiday entitlement before my notice period ends (ie so they don't have to pay me). However, I don't want to do this, and am relying on this pay to bridge the gap between leaving this job and finding another. There is nothing in the contract about redundancy, let alone how to use holiday if if happens, and the actual letter from HR that confirmed my decision to take redundancy, says they will pay accrued holiday at the end of employment! Plus they are paying holiday for some and not for others, and I've already had a conversation about being paid my holiday. Am I right in thinking that they have no right to force me to use the holiday, and are obliged to pay me what I'm owed?

Hi
It sounds like you shouldn't be forced to take your holiday as the letter mentions accrued holiday - and they are paying others as you say.
To get sound legal advice you could ask a solicitor on LawyerLocator free of charge - www.lawyerlocator.co.uk/
Good luck
