i require some help and advise from you legal eagles if you dont mind?
my daughter was dismissed last august from her apprenticeship hair dressing job for gross misconduct, i wont go into detail on a public forum ok, however the employer did not follow the acas guidelines regarding dismissal and after she excersised her right to appeal the dismissal it was strangely enough a week after the et1 form was received by the tribunal that she got a leter asking for her to attend an appeal, however due to her being on holiday at that time, which the employer already knew about as she had placed her holiday request form in to work well before her dismissal.
as my daughter wasnt in the country i had to contact the employer and did so by email and phone, to be told that he wont deal with me and thanked me for contacting them and they would re arrange for when she returned, she attended the following meeting to find that they did a no show!!!
a third time was later arranged.
by this time my daughter had instructed a company to help deal with this matter on her behalf, and we complide with their requests for information as and when they asked, we have now got to the stage where a date for tribunal has been set and that said company claims that they have ran out of money for her case, and no longer will be dealing with her or anything on her behalf,
we have to exchange witness statements etc etc by the 26 march 2010 and to be honest im going through the paperwork and finding that requests that my daughter has made to her ex employer have not been met, so this means that i will not be able to compliy with the required statement of loss as i dont not have the holiday entitlement details as requested of the 21 aug 2009, and i require to know about the holiday year, to work out exactly what she is claiming from the ex employer.
acas are unavailable and to be honest are very slow to pass info on to us, what can i do? do i go to the ex employer and demand this info? as i need to have it by 20th march at the very latest so as to be able to include this in the final statements.
